Car Wash Terms & Conditions | Breeze Car Wash

Breeze Car Wash Monthly Unlimited Plans allow each member to wash their enrolled vehicle each day of the month (weather permitting), but no more than twice per day. Each vehicle is required to have its own plan. Vehicles not enrolled in an Unlimited Plan will be charged full price. Enrollment into a Breeze Car Wash Monthly Unlimited Plan is considered acceptance of these Terms and Conditions.
Breeze Car Wash offers four monthly plans: Express Wash Monthly, Silver Wash Monthly, Gold Wash Monthly and Platinum Wash Monthly. Each plan provides for unlimited monthly washes in the single wash category that Breeze Car Wash provides.
Each vehicle will require its own unlimited wash pass and subscription fee. Breeze Car Wash Monthly Unlimited Plans are not valid with commercial vehicles. Commercial vehicles consist of vehicles in taxi and limousine fleets, Uber, Lyft vehicles in delivery fleets, vehicles that are part of a company or governmental agency owned fleets and that are used in the regular functions of that companies/agencies regular business.
The Breeze Car Wash Monthly Unlimited Plan can be purchased with a Credit/Debit Card only. The fee for the first month is charged to the customer’s card given at first purchase. Thereafter, the monthly fee is charged automatically to the same card the following months on the same date as purchased, until the pass is cancelled or terminated. Customers enrolling on the last day of a month will be charged on the last day of each month going forward until cancellation or termination.
If a discounted introductory or promotional offer period is available under the Breeze Car Wash Monthly Unlimited Plan purchased, then it will be specified at the time of purchase. The availability, duration, and any other terms for the introductory or promotional offer period may vary as determined by Breeze Car Wash at its sole discretion. At the expiration of any discounted introductory or promotional offer period, Breeze Car Wash will charge the then-current regular price for your chosen plan on your next billing cycle and your Breeze Car Wash Monthly Unlimited Plan will automatically renew at such then-current regular price unless you cancel your Plan prior to the end of the discounted introductory or promotional offer period, as set forth below. Promotional pricing offers are valid one time per account at startup, if available
The Breeze Car Wash Monthly Unlimited Plan will remain in effect until the end of the billing cycle in which you give notice of cancellation. Customer cancellations must be at least 7 days prior to the monthly recharge date (the “Notification Deadline”). You may cancel your Breeze Car Wash Monthly Unlimited Plan by visiting Breeze Car Wash, or by going online at breezecarwash.com or by emailing info@breezecarwash.com. You may continue to use your Breeze Car Wash Monthly Unlimited Plan up until the end of your current billing cycle. No refunds or partial adjustments or credits will be given for cancellations or because of temporary closure due to weather, holidays, equipment maintenance and upgrades. In addition, no refunds will be issued at any time for months in which the plan was unused or customer did not wash at all.
You may suspend your Breeze Car Wash Monthly Unlimited Plan at any time by providing notice prior to the Notification Deadline. You may suspend your Breeze Car Wash Monthly Unlimited Plan by visiting Breeze Car Wash, or by going online at mybreezecarwash.com or by emailing info@breezecarwash.com. After such proper notice, the suspension will go into effect on the first day of the next billing cycle. You may reactivate your Breeze Car Wash Monthly Unlimited Plan at any time, and your automatic billing cycle will commence.
If Breeze Car Wash is unable to charge the card on file for any reason, your Breeze Car Wash Monthly Unlimited Plan will be immediately deactivated. It is the customer’s responsibility to ensure that vehicle, credit card, and email contact information are correct and up to date.
The Breeze Car Wash Monthly Unlimited Plan is transferable to a new vehicle twice a year, free of charge. To change a vehicle, the customer must email Breeze Car Wash at info@breezecarwash.com to approve and facilitate any vehicle transfers.
The Breeze Car Wash Monthly Unlimited Plan is valid at Breeze Car Wash during normal operating hours. Breeze Car Wash reserves the right to close the car wash due to inclement weather and/or wet road conditions, repairs/maintenance, or any other unforeseen reason. No refunds will be given for these days.
The Breeze Car Wash Monthly Unlimited Plan is on per vehicle basis. No substitutions are allowed. Any unreported change of vehicle ownership will void your Breeze Car Wash Monthly Unlimited Plan. No coupons, discounts, or special offers are valid with the Breeze Car Wash Monthly Unlimited Plan.
Pricing Terms and Conditions are subject to change. Price changes will take effect immediately for new customers, and will be posted for 30 days before being applied to current plan customers. Any price change will be effective at the start of the next billing cycle after being posted for 30 days.
Breeze Car Wash reserves the right to terminate this subscription if the terms and conditions are violated or abused. In addition, Breeze Car Wash also reserves the right to refuse an initial or renewal monthly subscription for any reason (examples include, but are not limited to: pre-existing vehicle damage, vehicles that exceed height and/or width restrictions, damage risk to after-market equipment, excessive mud, etc.).
By entering into the unlimited program, you agree to the terms and conditions set forth by Breeze Car Wash and understand that any violation of the terms and conditions can result in immediate termination of the contract and/or refusal of services.
THE BREEZE CAR WASH MONTHLY UNLIMITED PLAN IS PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND (EXPRESS OR IMPLIED).
BREEZE CAR WASH DOES NOT REPRESENT THAT THE SERVICES ARE SUITABLE FOR YOUR VEHICLE(S). WITHOUT LIMITING THE GENERALITY OF SECTION 17 BELOW, BREEZE CAR WASH SPECIFICALLY DISCLAIMS LIABILITY FOR DAMAGE TO YOUR VEHICLE(S) WITH RESPECT TO THE FOLLOWING ITEMS:
Pre-existing damage and loose parts
Negligence (driving, steering, braking, etc.)
Electric running boards in lowered position
Aftermarket and non-factory parts
Antennas (please remove or retract)
Unsecured personal items
Racks (roof and rear)
Windshields
TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL BREEZE CARWASH LLC, OR ITS AFFILIATES OR SUBSIDIARIES OR ANY OF THEIR MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS (“BREEZE PARTIES”) BE LIABLE (JOINTLY OR SEVERALLY) TO YOU OR ANYONE FOR WHOM YOU PURCHASE A BREEZE CAR WASH MONTHLY UNLIMITED PLAN FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, WHETHER OR NOT THE DAMAGES WERE FORESEEABLE AND WHETHER OR NOT BREEZE PARTIES WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, THE BREEZE PARTIES’ AGGREGATE LIABILITY TO YOU OR ANY THIRD PARTY (WHETHER UNDER CONTRACT, TORT, STATUTE, OR OTHERWISE) SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU DURING THE ONE MONTH PRECEDING THE DATE THE CLAIM AROSE. YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE BREEZE CAR WASH MONTHLY UNLIMITED PLAN AND ACCESSING THE SERVICES. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THIS SECTION SHALL SURVIVE TERMINATION OR CANCELATION OF THESE TERMS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
